Read Your Fire Hydrant Ordiinance

ORDINANCE NO. 2005-1

AN ORDINANCE OF THE CITY OF CORBIN, KENTUCKY ESTABLISHING REGULATIONS FOR FIRE HYDRANTS IN THE CITY OF CORBIN, KENTUCKY; SETTING FINES AND JURISDICTION

BE IT ORDAINED by the Board of Commissioners of the City of Corbin, Kentucky, as follows:

SECTION ONE: It shall be unlawful for any person to open, close, or in any way tamper with a fire hydrant. Provided however, this prohibition shall not apply to personnel of the City of Corbin Fire Department and/or personnel of the City Utilities Commission.

SECTION TWO:  All fire hydrants shall at all times be visible from all approaches and accessible.

SECTION THREE:  All fire hydrants shall be continuously maintained and kept clear of weeds, rubbish and any and all other obstructions and clearance shall be maintained on all sides and above all fire hydrants.

SECTION FOUR:  Landscaping or decorations shall not obstruct or hide any fire hydrant from clear view, nor prohibit access for use and/or maintenance of fire hydrants.

SECTION FIVE:  Any landscaping or decorations within the general area of a fire hydrant that is damaged due to fire hydrant use or maintenance shall not be the responsibility of the City of Corbin, Kentucky or the Corbin Fire Department and/or the City Utilities Commission. The City of Corbin, Kentucky and the Corbin Fire Department and/or the City Utilities Commission shall not be liable for any aforesaid damage. 

SECTION SIX:  Parking, placing or locating any vehicle, boat, trailer or other personal property within ten (10) feet of a fire hydrant is prohibited.

SECTION SEVEN:   Preexisting fire hydrants must be accessible and operable for emergency use and for testing and maintenance purposes at all times. New fire hydrants installed  after the date of this Ordinance's passage shall meet the same requirements and maintain a minimum of ten (10) feet of clearance on all sides. New construction, fencing, landscaping and decorations after the date of this Ordinance's passage shall maintain a minimum of ten (10) feet of clearance on all sides. 

 

SECTION EIGHT: Dumpsters shall not be placed or located within ten (10) feet of any fire hydrant or a Corbin Fire Department sprinkler connection.

SECTION NINE: From the date of this Ordinance's passage any fire hydrant installed to the rear of any property shall have an access lane of no less than eighteen (18) feet wide, made of at least compacted crusted stone. Within the access lane there shall be no obstructions of any kind that would imped the movement of the fire vehicles.

SECTION TEN: It shall be unlawful for anyone to paint or mark any fire hydrant without the written consent of the Chief of the Corbin Fire Department and the General Manager of the City Utilities Commission.

SECTION ELEVEN: : It shall be unlawful for anyone to vandalize or render any fire hydrant inoperable.

SECTION TWELVE: The Chief of the Corbin Fire Department and the General Manager of the City, Utilities Commission shall be immediately notified any time a fire hydrant is inoperable or out of service.

SECTION THIRTEEN  The property owner and/or occupant shall notify the Chief of the Corbin Fire Department and the General Manager of the City Utilities Commission when a fire hydrant appears to be damaged.

 SECTION FOURTEEN It shall be unlawful to fill around any fire hydrant so that the hose nozzles and use of spanner wrenches are deemed inoperable and inaccessible. From the date of this Ordinance's passage it shall be unlawful to fill in around any fire hydrant so that the traffic flange at the bottom of any hydrant is less than six (6) inches to the ground.

 SECTION FIFTEEN It shall be unlawful for any person to obstruct the access to any fire hydrant by placing locating or permiting any debris, building material, personal property or other obstruction or, or about any fire hydrant which may in any manner interfere with its immediate use.

SECTION SIXTEEN: Any person in violation of this Ordinance shall be subject to a civil fine of not less than $100.00 or no more than $500.00 for each occurrence and/or violation The code enforcement board of the City of Corbin, Kentucky shall have jurisdiction to enforce this Ordinance.

SECTION SEVENTEEN: This Ordinance is necessary for the public safety and is in the best interest of the general public.

SECTION EIGHTEEN: All Resolutions, Orders, and Ordinances or portions of same in conflict herewith are hereby repealed.

SECTION NINETEEN: This Ordinance shall become effective upon its passage and legal advertisement.
